Welcome to Peas ("Peas", "we", "our", or "us"). By using our service, you agree to these terms.

1. Acceptance of Terms

By accessing or using Peas, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use our service.

2. Description of Service

Peas is a personal AI assistant that:

• Records and transcribes conversations from your Apple Watch
• Identifies speakers using voice recognition
• Tracks your location and activities
• Provides AI-powered daily summaries and insights
• Sends notifications based on triggers you configure

3. Getting Started

To use Peas, you must:

• Be at least 13 years of age
• Have an Apple Watch paired with an iPhone
• Keep your encryption key safe (we don't store it - if you lose it, your data is unrecoverable)

We don't require email, phone, or any personal identification to use Peas.

4. Acceptable Use

You agree NOT to use Peas to:

• Record conversations without required consent
• Violate any applicable laws or regulations
• Infringe on others' privacy rights
• Harass, stalk, or harm others
• Collect data about minors without parental consent
• Attempt to access other users' data
• Reverse engineer or exploit our systems
• Use our service for any illegal purpose

5. Your Content

You retain ownership of all content you create using Peas, including:

• Audio recordings
• Transcripts
• Voice signatures
• Notes and annotations

By using our service, you grant us a limited license to process your content as necessary to provide the service (transcription, analysis, storage, etc.).

6. Privacy & Data

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data.

7. Third-Party Services

Peas integrates with third-party services for transcription and AI analysis. These services may have their own terms and privacy policies:

• OpenAI (transcription and AI)
• Soniox (speech recognition)
• Apple (HealthKit, Watch connectivity)

8. Service Availability

We strive to provide reliable service but cannot guarantee:

• 100% uptime or availability
• Perfect transcription accuracy
• Real-time processing of all recordings
• Compatibility with all devices or configurations

We may modify, suspend, or discontinue features at any time.

9. Subscription & Payments

Some features of Peas require a paid subscription:

• Subscriptions renew automatically unless cancelled
• Refunds are handled according to App Store policies
• Prices may change with reasonable notice
• Free trials convert to paid subscriptions unless cancelled

10. Limitation of Liability

To the maximum extent permitted by law:

• Peas is provided "as is" without warranties
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the past 12 months
• We are not responsible for third-party actions or content

11. Indemnification

You agree to indemnify and hold harmless Peas and its operators from any claims arising from:

• Your use of the service
• Your violation of these terms
• Your violation of any third-party rights
• Your violation of recording or privacy laws

12. Termination

We may terminate or suspend your account if you violate these terms. Upon termination:

• Your right to use Peas ends immediately
• You may export your data within 30 days
• We may delete your data after the retention period

You may delete your account at any time through the app settings.

13. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance.

14. Governing Law

These terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
